breaking tonight, pushing the panic button. allies of president biden are now viewing robert f kennedy junior, a lifelong democrat, as the enemy and fox news polls released just this evening are indicating that when it comes to pulling votes away from the president, rfk junior will do just that. the senior national correspondent kevin corke is live in dc with a brand-new polls and what they mean for democracy 2024. >> reporter: top biden supporters inside the democratic party very worried. i mean really worried tonight over the threat that independent presidential candidate robert f kennedy junior poses to the biden reelection chances come this november. sources tell fox news that a tuesday afternoon phone call hosted by the dnc featured several key democrats and apparently they were voicing their concerns about the spoiler rfk junior and his chances at ruining biden saws in key swing states. that call accord -- occurred

shortly after kennedy announced his vp pick nicole shanahan. the tough news for the president doesn't end there because and brand-new fox news polling we find that the president is badly underwater with voters on the economy, inflation and immigration, and here's where things really get interesting. former president trump is leading mr biden by five points in a five way race with rfk junior clocking in at about 12 percent support. meantime in a head-to-head matchup, the former president also beats the current president by five, 50-45, building what had been a two-point trump lead in february. all this is happening as americans continue to support access to abortion according to our latest survey. fifty-nine-39 say they support the access and 68 in the new fox news survey say they would back access to medication -induced

[♪♪] [♪♪] the "fox news @ night" commonsense department is noticing that during campaign stops former president trump is asking the old question, are you better off today than you were four years ago? trump has now gotten a response from president biden who says " well, donald, i'm glad you asked that question, man, because i hope everyone in the country takes a minute to think back to what it was like in march of 2020. ." so if you have a minute commonsense would like to rewind the clock. in march of 2020 aaa says the average price of gas was a dollar 99 a gallon and today it's 353. mortgage rates averaged 3.29 percent and today it's a 7.2%. food up 25%, rent 22% up, credit card debt 47% up.

off 22%, were soft 52%, about the same, 26%. you can bind those two, worse off about the same, 78% are worse or about the same, those are very bad numbers. >> they are and we are in a unique position. we are not talking about what president trump would do or what president biden would do, we are talking about what they have done. we have seen four different years from two very different administrations and if i were president biden i would be very concerned about these numbers. >> trace: speaking of numbers, this is the fox poll president biden's job performance. you put these up there and you've got economy, approval rate 38%, disapprove 61%. inflation 34% approval, immigration 30% approval. i mean the numbers have to improve steve hilton or he's not going to win. >> will know. i mean look there's nothing he can point to that's gone well. actually it's too late now to

deal with these problems. i mean they clutch at straws and say well the price of this and that is going down but the key point is what you laid out. earlier which is that in order to bring inflation down they had to raise interest rates and that brings a whole new round of pain. that's not going to go away quickly and so the cumulative pain and the chaos at the border, that's not going to go away quickly because they refused to take the steps necessary and so on on every single issue and that's why it just feels like he's heading for defeat. >> trace: yep, you talk about heading for defeat, i want to put this out, this is a two way race between trump and biden. fox news polling shows the former president is up by five points. 50-45. then you go to a five way race which of course includes rfk junior and the numbers here kind of significant because of the former is still up by five. that has got to be concerning if you are in the biden camp, jessica. >> absolutely and we will see

this in the swing states particularly. we will see individual poles that are happening and what effect rfk is going to have in these races. that's why democrats, you know, the party of democracy, they are doing everything that they can to keep rfk off these ballots all around our country. we saw when they tried to do it with president trump, we seen it in california multiple times. their answer when it comes to opinions they don't agree with is keep them off the ballot. >> trace: karl rove said the following, i will get your final response after steve. >> even if they get a very small fraction of the boat, if it's in the right places it can cause enormous harm. they have a problem and they know it and how they are going to get out of it will be interesting to see. >> trace: you talk about bringing out the heavy hitters, even the former president barack obama is now getting involved in this and that shows that there's a little bit of concern. the alarm bells are bringing a little bit in dc. >> yeah, it's just too late.

everyone's was saying this ages ago. there was that round of panic when they said he should step down, we need a proper contest. nobody acted, they worked too cowardly to take him on, they let him just narcissistic late insist on running again and now they are stuck with him. one thing i want to add to jessica's point about taking things off the ballot. i know this well and so do you got here in california there's something important for california voters. taxpayer protection and accountability act. it would limit tax increases here in california. s what the democrats are doing? they are suing to take it off the ballot because they don't trust the voters. for all their lectures on democracy, they won't let the voters decide if it's something they don't agree with. >> trace: yeah, of course. thank you both, we appreciate it. meantime mcdaniel is out it and bc but the battle goes on and there is approximately $600,000 on the line.

pathetic. is anyone actually shocked at this? msnbc we knew was going to lean into this. they get so upset when you have any voice that disagrees with them and they've been so broken by donald trump that even someone who is a little bit connected to him, not from the administration, their heads just explode. it shows you how ideologically bigoted that network is and they are going to suffer as a result. all of us are better when we are challenged and when you only talk to people who agree with you, especially when you are that far to the left, it causes some problems and it sort of warps the reality of the world which you are living. >> trace: it's like covid in america really. the chairman of abc or nbc sorry said the following, we continue to be committed to the principle that we must have diverse viewpoints on our programs and to that end we will redouble our efforts to seek voices that represent different parts of the political spectrum.

about two and a half hours giving eight reasons to the federal judge why this case should be dismissed. we caught up with him after he spent that time before the judge. he declined to say much after he left court when we question him but he did start off bluntly in court telling federal judge the "one penetrating fact of this case is that after five years of investigating the u.s. attorney who's now special council, believed a plea agreement was appropriate for hunter biden. ." it was announced last june. they say that they then bowed to political pressure, ripping up the plea deal last july and reneging on a promise that was made. hunter biden was not physically in the courtroom today but does live in los angeles and that's what he's been charged here. an attorney with a special council's office told the judge today that his office is under attack, being singled out as

partizans giving the filings from hunter biden's legal team. is according to the special council instead of spit -- paying taxes, hunter spent his money allegedly on women, clothing, health and beauty products in adult entertainment to the tune of hundreds of thousands of dollars. the president's son also charged with federal firearms violations in delaware. he allegedly lied about his substance abuse on a federal firearms form when he owned a gun in 2018 for less than two weeks. that matter is set to tentatively go to trial in delaware the week of june third. on june 20th a few weeks later this tax case set to go to trial in los angeles. that means that hunter biden will have two trials likely and potentially even two convictions depending on what the jury does under his belt before his dad accepts the nomination at the convention later this summer in august. >> trace: sounds like we will see you back in los angeles this summer. >> i look forward to it.

>> trace: good to see you. let's bring in former house oversight committee chairman, great to have you on. the first lady, jill biden, said this about hunter... >> i think what they are doing to hunter is cruel. and i'm really proud of how hunter has rebuilt his life after addiction. you know, i love my son. >> trace: i mean it's kind of the same narrative here, that hunter biden was too drugged up to pay his taxes but not so high that he could not, you know, he could not squeal and squirm a little a few hundred million are a few million out of ukraine and china. what do you make of what's happening in the court with hunter biden? >> look, any time a mother supports her son, i totally see what she's doing and i understand that, i think every mother would try to support their son. i don't fault her for that. but the idea that they went to court to try to play the idea that hey, this is a politically

motivated prosecution, are you kidding me? that's pretty rich coming from the biden's. the only reason the plea deal fell apart wasn't because it was offered, it's because a judge looked at it and said we never ever have seen anything like this. that's why the deal fell apart, that's why they are in court now and when you have the chance to pay the self-assessment he believes was $1.4 million, he did not pay it. he went out and got prostitutes. that's the allegation. >> trace: the new york post writes the following, the indictment came after the implosion of an earlier plea deal, just like you were talking about, and allegations by two irs whistleblowers that the justice department interfered in the five-year probe into hunter's finances by blocking them from taking certain investigative steps or pursuing inquiries that could lead to joe biden. i mean it really was like a federal goal line stands at every turn in this case. >> i think the biggest travesty, the biggest weaponization of the

department of justice is to not allow professionals who are not political but professionals at the irs to fully pursue that case. they could not talk to joe biden, they could not talk to hunter biden, they could not pursue others. they got very special treatment and if we are actually going to do justice to this entire case, it's not about going after hunter biden who should obviously pay his taxes as joe biden preaches publicly, but it's how they suppressed whistleblowers at the irs from doing their job because daddy was vise president and then went on to become the president of the united states. >> trace: and that's how it appears. jason, great to see you as always, thank you. breaking tonight, the ntsb revealing the contents of the black box from the massive cargo ship that triggered the collapse of the francis scott key bridge in baltimore. christina coleman is live with the latest information on this. >> reporter: good evening trace. the ship's voyage data recorder was recovered and tonight ntsb

officials explain how it can provide authorities with critical information as they investigate this incident. >> the vdr recorded limited sensor data, an example including the ship's speed, rpm, heading and rotor angle as well as some alarm information. ntsb engineers are working to identify and validate that data. >> reporter: also the bodies of two of the six construction workers who were missing after the collision were found in a pickup truck submerged in about 25 feet of water near the bridge. tonight federal authorities had this message for their families... >> on behalf of the national transportation safety board, i just want to extend our deepest, deepest condolences. you are in our thoughts and prayers. >> reporter: there were 764 tons of hazardous materials on the ship at the time of the collision, some of their

containers were breached, 21 crew members two pilots were also on board. this incident happened in one of the busiest ports on the east coast, housing supply chain issues. >> the most urgent priority is to open up the port. it is essential to the livelihoods of people here in baltimore, in maryland, and also in fact the economies of the region and will impact people around the country and around the world. the port handles more cars and more farm equipment than any other port in the country. last year alone the port handled $80 billion of foreign cargo, the largest in the country. >> reporter: as of now it's unclear how long it will take before the bridge will be replaced and for this port to reopen. >> trace: looks like it might take a while. thank you. coming up, a legal immigrants are clearly invading texas. we have the pictures to prove it again and again. but an appeals court says

[♪♪] [♪♪] >> trace: breaking tonight, a federal appeals court has blocked the texas immigration law known as s b four meaning state and local law enforcement cannot arrest and detain illegal immigrants. in other words the court says protecting the border is up to the feds even though the feds won't protect the border. ashley is live with that story. good evening. >> reporter: texas officials are facing another legal setback in their pursuit to secure the

southern border. a federal appears appeals court ruled that the texas law allowing state authorities to arrest migrants suspected of illegally crossing the border cannot be enforced while the case plays out. the chief judge said that it is the president's job to "decide whether and if so how to pursue noncitizens illegally present in the united states." the white house praised that decision. >> we welcome the fifth circuit and their decision overnight, pausing the implementation of it ultimately we need real solutions. we need that decision that negotiation proposal that came out of the senate in a bipartisan fashion. we need that to move. >> reporter: critics on the other hand argued that the state should be able to step in if they believe the federal government has failed in it's duties to protect citizens, like an apostle last week where migrants rush the border. nine of them now facing charges including assault. inciting a riot and damage of property. and then on sunday a migrant was

caught on video cutting through razor wire and just last night we told you about the so-called walk always in california and arizona, were border agents are too overwhelmed by the sheer numbers coming in to make arrests so migrants are free to leave and disappear into the u.s. and the appeals court decision is made all the more stark buy how the migrant crisis is being handled further north. while texas is being told they cannot stop illegal immigrants from entering their state, new york city is starting to distribute prepaid debit cards to some migrants arriving there. >> trace: and on it goes. ashley live in new york, thank you. let's bring in former border patrol chief rodney scott. thank you for coming on. ashley kind of laid it out there, the judge says texas cannot enforce the laws down there, that's a federal job. the feds are doing it and you can clearly see from the pictures they are being invaded every single day. >> yeah, i think we've note -- things for having me off. i think we've known for a while

this case will end up in the supreme court. basically it was stayed what they look at the merits but the argument on behalf of texas is different than anybody's argued before and you hit on it. it's a constitutional argument, not necessarily a traditional legal argument. under the constitution, states, the federal cover -- guarantees the states will be protected from invasion but there's also another clause, article one section ten, clause three, that allows the states to protect themselves of the federal government does not and that's what texas is arguing here. and this is an invasion. we are watching the migrants but everyone forgets that control -- cartels control every bit of this and they are basically a nationstate level as far as violence and weaponry. >> trace: it really is crazy. we moved to california and you have hundreds that are crossing the border, walking across the border, looking to get apprehended by the border contract -- patrol but because there's no border patrol

resources the judges saying you are free to go out so they are just roaming about the country. it's an unbelievable dichotomy that we've never seen in the history of this country. >> and i honestly think that's the point that i hope all of your viewers take away from this. we have never seen this. there's never been a presidential administration that did not try to secure the border there's always been influxes, i will agree with that, but every single administration, democrat or republican prior to this one, stop the flow and did everything they could to protect americans by securing the border and making sure we know who and what enters the country. this administration completely walked away from it and encourages this chaos on a daily basis by fighting states like texas. >> trace: they encouraged it to begin with and now they encourage it every single day by going after the states that want to stop it. rodney scott, great to have you on the show, thank you. >> thank you trace. >> trace: meantime brand-new detail, videos and reaction from

he had cameras hidden in every room in his home, has recordings of celebrities, artists, music executives and athletes engaging in illegal activities recorded without their knowledge or consent. >> they took his electronics. they will go through every single line of every text and every e-mail and try to interpret what he's saying. >> i think the feds are sending a very loud and public message, they are trying to get witnesses to come aboard. >> also identified in the complaint, combs personal drug mule who was released for cocaine and possession in the same airport in miami where this tmc photo shows combs after he delayed a trip to the curb in with his daughters. the u.s. attorney's office in new york is reportedly handling this investigation. tran16 recently said on instagram he's innocent of "the awful things being alleged."

>> trace: thank you, let's bring in former fbi special agent nicole parker and founder of a christian ministry for young black men, conservative radio host veteran jesse lee peterson. great to have you on. nicole, this is an attorney for diddy who said yesterday was a gross overuse of military force. there is no excuse for the excessive show of force and hostility exhibited by authorities or the way his children and employees were treated. i mean they must have something here. what do you think about this? >> with all due respect to his attorney, i absolutely disagree with his assessment of how that was conducted. having been a former fbi special agent and work to these types of investigations involving violent crime, violent crimes against children, sex trafficking, these are the most dangerous types of offenders that federal agents will oftentimes come into contact with. many people may not realize that but they are the ones that many times when they are caught they

are the most desperate. for him to say it was an excessive use of force, i completely disagree. law enforcement safety comes first. we are seeing how law enforcement is getting attacked. i mentioned it on your program, very dear friend was shot and killed when executing a search warrant against a child predator so it was not excessive use of force. we have the right to defend ourselves and swat is justified in certain searches and there are swat chocolates and if swat was sent it's because the circumstance merited that type of response -- swat checklists -- and based on what i saw the federal agents were externally professional and law enforcement safety should be first. >> trace: ntu reverent, what do you think socially of this? how is this affecting -- what are you hearing about this case? >> what a mess. [ laughter ] >> trace: yeah, right? >> first of all he's innocent until proven guilty but the bigger picture here is that parents have to raise their children not to put entertainers

or anyone on a pedestal and not to want anything from anyone that you are willing to do anything to get. so the entertainment world is very seductive and especially for millenials and younger generations. they have a lot of money, their own youtube, everywhere, and kids who have not been raised to do things in a proper way would be easily seduced by that and i think there's a lot going on here with diddy and we are going to see more of this if we don't cut back on this, if we don't teach our children not to put people on a pedestal we will just see more of this. kids are easily seduced. >> trace: speaking of social media, what about tiktok, here's a woman who was sucker punched in new york, one of several. listen to her. >> so last week i was assaulted in new york city as you can kind of see here with my blackeye. if you know me, you know that

this isn't something i would typically publicly talk about but i feel that this is something women need to be more aware of. >> trace: these women are lining up, they are getting punched in new york city and you think what is going on. >> will what's going on is that new york city is lacking in law and order. i used to live in new york city and it is a completely different city than it used to be 20 years ago. when you don't enforce laws and there's no consequence for those that are hurting others and conducting crimes, then the crimes are going to continue and people are just acting inhumane. a lack of human respect and human decency. if you are not going to do the right thing because it's the right thing to do, then you need the law enforcement to step in and to cause individuals to not treat people with such disrespect. i mean that's inhumane, to go around and punch people in the face. >> trace: and a lot of these people are young people that are committing these crimes. your final thoughts on this? >> unfortunately this will get worse because white people have been made out to be the enemy. made out as the problem for

would see these protesters out there and think this is embarrassing, how can they do this, how can people allow this, and now they keep protesting. and colleges across the country and it appears they are starting to win this war. >> it does appear that way. what i want people to pay attention to here is the blatant generational divide we've seen on display since october 7th. a divide amongst people based on how they view the war in gaza and even a divide that goes as far as to how americans view what actually happened on october 7th in israel. it's a divide that signifies something a lot deeper than just a disagreement about what's going on in gaza right now. it's one the administration clearly has to grapple with, when they have to navigate when it comes to this election. clearly that's top of their mind but it's also one that this country will have to grapple with and navigate for many years to come. >> trace: i want to put this up on the screen because this is research on the question is, those who say israel's reason for fighting hamas are valid. you can see there that ages

18-29, only 38% think that israel's reason for fighting are valid. thirty-eight%. it just seems as time goes on, elizabeth, we keep losing more and more young people and that is troubling. >> it is and where do young people get their information these days? i think it's their college campuses, their peers, their professors or social media. i've said for years i don't think young people should be on social media. it is dangerous. this is the kind of propaganda that's been going into these young people's minds for years. people did not realize how dangerous i could be and now we are seeing, like we've seen on your show many times now, many young people in the united states are thinking they should side with hamas in this war. >> trace: and it really is. the thing that i keep kind of going back to and we have talked about this many times is that it goes from college campuses. we talk about college campuses a lot but it goes from college campuses and you see some of the same age groups out and about in dc back in new york, where the

protests become a daily, weekly occurrence and they get bigger and bigger and bigger as time goes on. >> they do. i don't think they are stopping anytime soon. i think for these protesters, this signifies something a lot bigger than just the war, it's their hatred not only for what they believe israel is doing incorrectly but also for what they disagree within the united states of america. this is a bigger problem than just adjust agreement amongst americans when it comes to what's going on in gaza. these are the same protesters that are burning american flags at their rallies. it's so much bigger than just a problem in the united states amongst people that don't like what's happening when it comes to the israeli government. this is a problem with people who want to take notches down israelis but americans as well. >> trace: great analysis, thank you. coming up, baseball food is normally hotdogs, peanuts and
